Sales Terms
LP FOTO undertakes, under the conditions specified below, to act as an agent in its own name to sell the items submitted by the seller at auction to the highest bidder. At the time of submission, a joint sales contract will be established between LP FOTO and the seller, in which both parties agree in writing to the sales terms outlined below. Oral agreements are not binding.
Items can be submitted for auction at our location on Tulegatan 39, Stockholm. At the time of submission, we will also agree on a starting price, any reserve price, and a suitable auction date. The seller is responsible for ensuring that they have full and unrestricted ownership of the items they submit to LP FOTO for sale or full and unrestricted authority to sell items owned by third parties and to collect payment for sold items. However, LP FOTO is not obliged to verify the seller's authority to sell at auction without specific reason. If the seller withdraws the sales mandate, they shall compensate LP FOTO for its expenses related to valuation, cataloging, etc., of the items, amounting to a full sales commission based on the starting price.
LP FOTO is responsible for ensuring that submitted items are stored securely. LP FOTO is not liable for mechanical/electronic faults that may occur on items during cataloging or at the time of display.
LP FOTO charges a sales commission of 20% including VAT (currently 25%) on the hammer sale price. LP FOTO charges a mini-commission of SEK 150 per item and a photo fee of SEK 100 including VAT per image published in the printed catalog (normally one image). We do not charge any extra cost for the images published on the website (usually four to five images). The seller can freely recall items in agreement with LP FOTO at no cost up to 80% (eighty percent) of the assigned starting price. However, this does not apply to items with a starting price under SEK 1,000 (one thousand kronor), which are generally sold without reserve. Unsold items must be collected no later than 15 (fifteen) working days after the auction unless otherwise agreed, after which a storage fee of SEK 30 per item and calendar day will be charged. If the items have not been collected within 40 (forty) working days after the auction, LP FOTO has the right to resell the items at the seller's own risk at a new auction under the agreed reserve price.
Account settlement and payment to the seller will occur no later than 30 (thirty) working days after the end of the auction, but no earlier than 10 (ten) working days after full payment has been received from the buyer. LP FOTO has no obligation to take legal action against buyers to compel payment. If the buyer fails to pay, LP FOTO has the right, at its discretion, to cancel the sale and resell the item at a new auction or to cancel the sale and return the item to the seller free of charge.
Any claims for damages against the buyer will only be pursued by LP FOTO in agreement with the seller. If LP FOTO becomes liable to the buyer for faults in sold items, LP FOTO has the right to seek compensation from the seller equivalent to the amount that LP FOTO may have paid to the buyer due to the fault, according to the purchase terms that LP FOTO applies at auctions.
Force Majeure
LP FOTO is not liable for losses incurred by the seller due to canceled auction sales or delayed cash payments due to war, war-like events, civil war, riots, natural disasters, currency restrictions, labor disputes, and similar circumstances that LP FOTO cannot control or influence.
Disputes regarding purchases at auction or these purchase terms with LP FOTO shall be resolved according to Swedish law in a court in Sweden.
